Provisional version. Should I Bid is not yet incorporated as a company. The information shown in brackets […] will be completed once the company is officially registered. This document does not yet constitute a final contractual commitment.
These Terms of Service (the "Terms") govern access to and use of the Should I Bid platform (the "Service"), operated by [LEGAL ENTITY NAME]. By creating an account or using the Service, you fully accept these Terms.
Should I Bid is a keyword intent analysis tool designed to help advertisers decide which keywords to target in their Google Ads campaigns. The Service is provided as SaaS, accessible online.
Access to the Service requires creating an account. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity carried out from your account.
The Service operates on a credit basis: one (1) credit corresponds to the analysis of one (1) keyword. Credits are deducted once the analysis has actually been performed. The pricing terms in force are shown on the Pricing page. Payments are processed by our provider Stripe.
You agree not to use the Service for unlawful purposes, not to attempt to compromise its security, and not to automate abusive usage likely to degrade the quality of the Service for other users.
Pooled market data: the Google results pages consulted by the Service are public information. The ads they contain (advertiser, keyword, position, copy, date) are kept in a shared, anonymized and aggregated database available to all users of the Service (the “Competitors” feature). No information about your account, your analyses, your clients or the origin of an observation is shared. By using the Service, you agree that the search results consulted on your behalf feed this shared database.
The Service, its brand, its interfaces and its code remain the exclusive property of [LEGAL ENTITY NAME]. The data and analyses generated for your account remain intended for you, within the limits of this agreement.
The analyses provided by Should I Bid are a decision-support aid and not a guarantee of advertising performance. [LEGAL ENTITY NAME] shall not be held liable for advertising investment decisions made on the basis of the Service.
You may stop using the Service and close your account at any time. [LEGAL ENTITY NAME] reserves the right to suspend an account in the event of a breach of these Terms.
These Terms may be updated. Users will be informed of any material change. The applicable version is the one in force on the date the Service is used.
These Terms are governed by the law of [COUNTRY/JURISDICTION]. Any dispute falls under the jurisdiction of the courts of [CITY], subject to mandatory legal provisions.
